21日提请全国人大常委会审议的关于刑法有关规定的解释草案明确指出，知道或者应当知道是国家重点保护的珍贵、濒危野生动物及其制品，为使用或者其他非法用途而购买的，将被追究刑责。也就是说，从市场买珍贵、濒危野生动物来吃或到餐馆专门点吃的，将受到刑法处罚。
